Note on the Law of the People ' s Republic of China on Cybersecurity (draft of amendments for further comments)

The party centre attaches great importance to the maintenance of national cybersecurity. General Secretary Xi has repeatedly given important instructions emphasizing that “there can be no national security without cybersecurity, no stable economic and social functioning, and the interests of the population at large cannot be guaranteed”. The 20th and 20th Plenums made important deployments to strengthen focus areas, emerging areas, legislation in the foreign sphere and to strengthen its systemic, holistic, synergistic, time-bound nature. In order to follow up on the Party ' s central decision-making and to implement the Legislative Plan of the Standing Committee of the XIV National People ' s Congress and adapt to the new situation of cybersecurity, my Office, together with the relevant authorities, has drafted the Law of the People ' s Republic of China on Cybersecurity (the revised draft re-advisory draft) (hereinafter referred to as the " Cybersecurity Act " ). Information is provided below. I. Modification of the background Since its introduction in 2017, the Cybersecurity Act has provided strong legal safeguards for the protection of cyberspace sovereignty and national security, the public interest and the legitimate rights and interests of citizens, legal persons and other organizations. Cyber-security risks are further highlighted as networks and information technologies become increasingly integrated into productive life. Since 2021, legislation relating to cybersecurity, such as the Law of the People ' s Republic of China on Data Security (hereinafter referred to as the Law on Data Security), the Law of the People ' s Republic of China on the Protection of Personal Information (hereinafter referred to as the Law on the Protection of Personal Information), has been enacted and implemented. The Law of the People ' s Republic of China on Administrative Penalties (hereinafter referred to as the Law on Administrative Penalties) has been amended. The Law on Cybersecurity needs to be adapted to the situation and harmonized with the newly enacted laws, with a view to optimizing the scientific aspects of the legal liability regime and further ensuring cybersecurity. In September 2023, the Legislative Plan of the Standing Committee of the Fourteenth National People's Congress was published, expressly including the “Law on Cybersecurity (Amendment)” in the first category of “Projects: more well-established draft laws to be submitted for consideration during the term of office”. In March 2025, the report on the work of the Standing Committee of the National People ' s Congress included amendments to the Cybersecurity Act in the legislative mandate for 2025. Since the beginning of the revision process, I have been working closely with the relevant authorities to promote the revision of the Cybersecurity Act, which has led to research, the drafting of draft amendments, the consultation of relevant units of the central and State authorities and the public consultation process. On the basis of careful consultation with interested parties, the Cybersecurity Act (a revised draft re-advisory draft) was developed. II.
